Terms of Service

1. Acceptance of Terms

By accessing and using OutboardListings.com (the “Site”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Site.

2. Platform Description

OutboardListings.com is a classified advertising platform that brings buyers and sellers of marine engines, parts, accessories, and forum postings together. We are like a Craigslist or an eBay acting solely and only as a classified outboard engine website for communication and advertising. We do not take part in any sales of products and therefore are not responsible or will be held liable for products you purchase with the help of this website.

3. Listing Fees

OutboardListings.com charges upfront fees for classified listings. This paid-only model ensures that sellers are serious and motivated, and that advertisements are current. All sales are final. No refunds. We cannot offer any guarantees, express or implied, regarding the timeframe in which products will sell. Product demand dictates search and exposure.

4. Advertising & Sponsored Placement Terms

The following terms apply to all banner advertisements, sponsored placements, and any other paid advertising purchased on OutboardListings.com (collectively, “Ad Purchases”).

4.1 No Performance Guarantees

OutboardListings.com makes no guarantees, representations, or warranties — express or implied — regarding the performance of any Ad Purchase. This includes, but is not limited to: click-through rates (CTR), cost per mille (CPM), impressions, conversions, return on investment (ROI), return on ad spend (ROAS), lead generation, revenue, or any other metric of advertising performance.

Advertising results vary based on factors outside our control, including ad creative quality, market conditions, seasonality, and user behavior.

4.2 Refund Policy

All Ad Purchases are final. No refunds — partial or full — will be issued for assumed, expected, or perceived underperformance of any advertisement.

The sole exception is as follows: if OutboardListings.com is unable to launch your advertisement and cannot provide reasonable proof that the ad was served during the purchased campaign period, a full refund for that specific Ad Purchase will be issued.

4.3 Ad Content & Approval

All ad creatives are subject to review and approval by OutboardListings.com. We reserve the right to reject or remove any advertisement that, in our sole discretion, is misleading, offensive, unrelated to the marine industry, or otherwise inappropriate. Rejection of ad creative does not entitle the advertiser to a refund provided we offer a reasonable opportunity to submit revised creative.

4.4 Campaign Duration

Ad campaigns run for the duration specified at the time of purchase. OutboardListings.com is not responsible for extending campaign periods due to low traffic, site maintenance, or any other circumstances. Unused impressions or days do not roll over or carry credit.

4.5 Placement & Positioning

Advertisements are placed in designated ad zones across the Site. While we make reasonable efforts to deliver placements as described at the time of purchase, exact positioning may vary based on page layout, device type, and screen size. Placement adjustments do not constitute grounds for a refund.

4.6 Indemnification

Advertisers agree to indemnify and hold harmless OutboardListings.com, its owners, employees, and affiliates from any claims, damages, or liabilities arising from the content of their advertisements or any products and services promoted therein.

4.7 Corporate Sponsorship ($10,000/year)

Corporate Sponsorship is a 12-month commitment billed annually or quarterly ($2,500/quarter). Corporate sponsors receive: site-wide logo placement in the Sponsor Strip above the footer on every page, category-exclusive ad zone placement, co-branded blog and forum content, sponsored newsletter inclusion, a custom landing page on OutboardListings.com, priority placement across all self-serve ad zones, and quarterly performance reports.

Corporate sponsors receive priority ad placement over all self-serve tier advertisers (National, Forum, Hyper-Local). In the event of a scheduling conflict or zone capacity limit, Corporate and Enterprise placements take precedence. Cancellation requires 60 days’ written notice to [email protected]. No pro-rata refunds are issued for early termination.

4.8 Enterprise Partnership ($35,000/year)

Enterprise Partnership is a 12-month commitment billed annually or semi-annually ($17,500/half). Enterprise partners receive everything included in Corporate Sponsorship, plus: presenting sponsor credit on all site pages (header and footer), a full-width leaderboard banner above the footer on every page, a dedicated partner showcase page, co-produced video content and branded forum sections, event cross-promotion via the Weekender Planner, API-level data integration for inventory or product feeds, a dedicated account manager, monthly strategy calls with a real-time analytics dashboard, first right of refusal on new premium placements, and a featured offer card on the Enterprise Offers page.

Enterprise partners receive the highest priority ad placement across the entire platform, superseding both Corporate and self-serve tier advertisers. Cancellation requires 90 days’ written notice to [email protected]. No pro-rata refunds are issued for early termination.

4.9 Enterprise Offers Page

Corporate and Enterprise partners may feature exclusive promotional offers (“Enterprise Offers”) on the dedicated Enterprise Offers page at OutboardListings.com/enterprise-offers. These promotions are created and fulfilled entirely by the partner. OutboardListings.com acts solely as a publishing platform for these offers and makes no guarantees regarding availability, redemption, or fulfillment of partner promotions. All offer terms, conditions, and disputes are between the partner and the redeeming user.

4.10 Priority Placement Hierarchy

Ad placement priority across OutboardListings.com follows this hierarchy, from highest to lowest:

  1. Enterprise Partners ($35,000/year) — highest priority across all zones and pages
  2. Corporate Sponsors ($10,000/year) — priority over all self-serve tiers
  3. National Coverage (self-serve, from $249/month)
  4. Forum Only (self-serve, $149/month)
  5. Hyper-Local (self-serve, $79/month)

In the event of a conflict where multiple advertisers are assigned to the same zone or page, higher-tier advertisers will be served first. Self-serve advertisers acknowledge that Corporate and Enterprise placements may reduce available rotation slots in shared zones.

5. Permitted Content

Ads must be for outboard engines, outboard engine parts, accessories, or related marine items only. Ads for non-outboard items will be refused or deleted, and associated accounts will be banned. Each image upload has a maximum file size of 2MB. Users are responsible for ensuring the accuracy of their listings.

6. User Conduct

Users agree not to post fraudulent, misleading, or deceptive listings. Users agree not to harass, spam, or abuse other users through the messaging system. Users are responsible for maintaining the confidentiality of their account credentials.

7. AI Engine Detection & Scanner Resources

Our Outboard Scanner uses AI technology to suggest engine specifications from photos. These suggestions are provided as a convenience and are not guaranteed to be accurate. Users are responsible for verifying and confirming all engine specifications before posting a listing.

Paid Profile Required. The AI Outboard Scanner is available exclusively to users with an active paid profile (membership). Each scan consumes computational resources including AI processing, image analysis, and database cross-referencing that are consumed the moment a scan is initiated.

Non-Refundable. Because scanner resources are consumed instantly and irreversibly upon use, AI Scanner usage is generally non-refundable. This applies to scans that produce incomplete or inaccurate suggestions, user error, poor photo quality, or general dissatisfaction with results.

Refund Exceptions (Scanner):

  • Scanner System Failure: If the AI Scanner experiences a verified system-level failure (e.g., server error, API outage, or processing crash) that prevents any results from being returned, a full refund or credit for that scan will be issued upon request.
  • Manual Upload Failure: If you upload your engine photos and OutboardListings.com is unable to manually process, post, or list your images within 7 business days, and cannot provide reasonable proof that the listing was created, you may request a full refund for the associated listing fee.

8. Intellectual Property

All content, design, and technology on OutboardListings.com is the property of Proxy1Media.com LLC. Users retain ownership of their listing photos and descriptions. By posting on the Site, users grant OutboardListings.com a non-exclusive license to display their content for the purpose of operating the platform.

9. Limitation of Liability

OutboardListings.com shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use of the Site, transactions between users, or reliance on AI-generated engine specifications.

10. The Weekender™ Event Platform

The Weekender™ is a feature of OutboardListings.com that aggregates boating events from third-party sources. Event information is collected through automated scanning and is provided for informational purposes only. We do not guarantee the accuracy, completeness, or timeliness of event listings. Users should verify event details directly with the organizing body.

OutboardListings.com is not responsible for event cancellations, schedule changes, or any losses incurred from reliance on event information displayed on the platform.

11. SMS Text Message Terms

By opting in to The Weekender™ SMS Alerts, you agree to the following terms:

  • You consent to receive recurring automated text messages from OutboardListings.com at the mobile phone number you provide.
  • Message frequency may vary, up to 8 messages per month.
  • Message and data rates may apply. Check with your wireless carrier for details.
  • Consent to receive text messages is not a condition of purchase or use of any service.
  • You may opt out at any time by texting STOP to our SMS number. You will receive a one-time confirmation message and no further messages will be sent.
  • For help, text HELP or visit our Contact Page.
  • Supported carriers include AT&T, Verizon, T-Mobile, Sprint, US Cellular, and other major US wireless carriers.
  • Carriers are not liable for delayed or undelivered messages.

12. Email Communications

By creating an account, you consent to receive transactional emails including account verification, listing confirmations, and messages from other users. You may also opt in to receive event alerts and promotional emails. You can manage your email preferences from your dashboard or unsubscribe at any time.

13. Privacy

Your use of the Site is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Site, you consent to the practices described in the Privacy Policy.

14. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated “Last updated” date. Continued use of the Site after changes constitutes acceptance of the modified terms.

15. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising from these terms shall be resolved in the courts located in Duval County, Florida.
